How Is Child Custody Determined?

When determining child custody, the court considers the child’s best interests first and foremost. Then, they look at several determining factors, including:

  • The child's wishes
  • Each parent's wishes
  • The relationship the child has with each parent
  • The school & home adjustments the child would have to make
  • The mental and physical wellbeing of each parent
  • If the parents can encourage a relationship with the other parent
  • If there is a history of sexual assault or molestation
  • If one parent is on active duty in the military
  • Each parent's living accommodations
  • The best interest of the child

Joint custody is the preferred resolution if each parent's living situation is adequate and the child will benefit from such an arrangement. If you and the other parent are awarded joint custody, you must resolve all disputes that you have regarding the custody agreement. The state does not allow you to modify your child custody arrangement until at least two years have passed, or if the current custody arrangement puts the children in any mental, physical or emotional danger.

In the case that one parent is not granted custody, they will get visitation rights unless the court:

  • Thinks visitation would be a serious danger to the child's emotional stability or health
  • Thinks the child will not be protected in such an arrangement

I can thoroughly explain how state child custody laws impact your case in an understandable yet comprehensive manner. Since most people don’t have a deep knowledge of child custody laws, I will take the time to ensure you are up to date so you can feel more confident in your case and in yourself.

Child Custody & Divorce

A divorce always becomes a larger issue when a child is involved, and should be treated with the appropriate care and priority as a result. Oftentimes, the other parent disagrees with your idea of the best scenario for your child or children. That’s why having a knowledgeable and compassionate Batavia child custody lawyer on your side could be the key to successfully working toward a healthy future for you and your children.

It is possible to achieve a simple and peaceable child custody solution and/or a visitation schedule that works for both parents. It is best to resolve these matters outside of the courtroom, but if mediation is not an option, I will be an aggressive voice inside the courtroom to fight for that what you deserve.

If you are seeking an agreement in your child custody matters, contact my firm today and call (630) 280-3879 for a free case evaluation!
